New Jersey Bankruptcy Law Practice

My observations from my recent FDCPA (Fair Debt and Collection Practices Act) conference in Baltimore

I have just returned from the FDCPA Fair Debt Collections Practices Act Seminar sponsored by NACA, The  National Association of Consumer Attorneys in Baltimore.

I also got to enjoy the Inner Harbor a bit, even with the brisk weather!

As many of you know, there is truly no love lost in New Jersey, or nationally, for debt collectors.

In 2013 some of accounts of calls that my clients receive and share with me continue to “shock the conscience” and sadly many of these calls still remain illegal under the FDCPA.

I learned some great strategies and approaches to handling debt collectors and mortgage servicing abuse at this conference. These are approaches to use against collection agencies and new valuable litigation skills my team and I are ready to use when consumers are sued. The sessions were led by nationally recognized  experts who have been successfully combating many of these defense tricks in courtrooms around the country.  As always, for me, it was very exciting to learn inventive ways and ideas to help our clients now with many of these collection abuses.

We have also had some interesting sessions on the TCPA, the Telephone Consumer Protection Act, a new tool to stop illegal unrelenting and unwelcome phone calls. I continue to see situations in our office where collectors’ abusive telephone calls have caused work loss, anxiety and emotional distress.  This cannot be tolerated.

Please note that we cannot and do not accept every case, however, we remain available to discuss these situations if they are impacting you, your clients or your colleagues. We invite referrals in the area of debt collection abuse, FDCPA and the consultation is always, without charge.
