Federal law also provides protection against debt collection agencies under the Fair Debt Collection Practices Act (FDCPA). If a debt collector contacts you, they should inform you from the start that “This an attempt to collect a debt. Any information obtained will be used for that purpose.” You have the right to know what exactly you are being asked to pay and request the debt collector to check the debt. All requests must be done in writing.

Under the FDCPA, you can send the debt collector a letter stating that you do not want the collection agency to contact you anymore. Always send all communications by certified mail, return receipt requested and keep copies for your own records. If you have an attorney, debt collectors may not contact you, your relatives or friends but may only communicate directly with your attorney.
